Plan ahead with a full calendar of national holidays and tourism peaks to budget overtime costs.
Per Article 39 of the Labor Standards Act, employers must pay regular wages on national holidays. If an employee works on a holiday, the first 8 hours are paid at 2× regular rate; hours beyond 8 follow extended-hours overtime rules. Example: hourly wage NT$200 × 8 hrs × 2 = NT$3,200.
Rest days (Article 36) use a tiered multiplier — 1.34× for the first 2 hours, 1.67× for hours 3–8, double beyond 8. Holidays apply a flat 2× for all hours up to 8, making them more lucrative for workers and more expensive for employers.
Yes, with employee consent (Article 32-1). Comp hours = worked hours × multiplier (e.g., 8 holiday hours = 16 comp hours). Unused comp time within the agreed window must still be paid out at the end of the period.
